Terms of Service

1. Agreement to Terms

By creating an account or using the Datapio platform, API, or website at datapio.app (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Datapio is a software-as-a-service platform that provides programmatic access to publicly available social media data via a REST API. The Service operates on a credit-based model: customers purchase credits that are consumed per API request. The Service includes the API itself, the customer dashboard, documentation, and all related tooling.

2.1 Public Data Only

Datapio exclusively retrieves data that is publicly visible — data that any person can view on the relevant platform without creating an account or logging in. This includes public profiles, public posts, public search results, and other publicly accessible content.

Datapio does not access, retrieve, or transmit:

  • Private accounts or content restricted to followers or approved connections
  • Direct messages, private messages, or any non-public communications
  • Account credentials, passwords, or authentication tokens of end users
  • Any content that requires a personal login to view

By using the Service, you confirm that your use of publicly available data complies with all applicable laws and regulations in your jurisdiction.

API access is authenticated via API keys generated in the dashboard. Rate limits apply to all API requests to ensure fair usage and service stability; current rate limits are published in the documentation and dashboard.

To improve performance and reduce latency, the Service may return cached responses for identical or equivalent requests made within a short window. Cached responses are served at no credit cost — credits are only consumed for fresh, uncached requests.

The Service does not permanently store or archive the social media data retrieved on your behalf. Responses are delivered to you in real time. Temporary caching for performance purposes is limited to 15 minutes; after that window, data is discarded from our systems.

3. Account Registration and Security

You must sign in using a supported OAuth provider (Google or Apple). By signing in, you confirm that the information provided is accurate and that you are at least 18 years old. You are solely responsible for:

  • All activity that occurs under your account
  • Keeping your API keys confidential and secure
  • Notifying us immediately at support@datapio.app if you suspect unauthorized access

You may not share, sell, sublicense, or transfer your API keys or account access to any third party without our prior written consent.

4. Credits and Billing

  • Credit system: Each API request consumes a number of credits determined by the request type. Current credit costs are published in the dashboard and may change with 14 days' notice.
  • Free trial credits: New accounts receive a one-time allocation of free credits. These credits have no monetary value and cannot be refunded or exchanged for cash.
  • Purchased credits: Credits do not expire and are non-transferable between accounts.
  • Pricing: All prices are in USD and exclude applicable taxes. You are responsible for any taxes applicable to your purchase.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You must not:

  • Violate any applicable local, national, or international laws or regulations
  • Access data in a manner that violates the terms of service of the source platform
  • Use scraped data to harass, stalk, discriminate against, or harm any individual
  • Resell, redistribute, or sublicense API access or scraped data as a competing service
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Circumvent rate limits, authentication mechanisms, or credit controls
  • Introduce malware, viruses, or any code designed to harm the Service or its users
  • Overload, disrupt, or degrade the performance of the Service infrastructure
  • Use the Service to collect data for mass profiling, surveillance, or unauthorized tracking

We reserve the right to suspend or terminate any account that violates this policy without notice and without refund.

6. Data and Compliance

The Service accesses only publicly available data — data that any person can view without logging in to the relevant platform. Datapio does not scrape, intercept, or process private, restricted, or authenticated content at any point. Our infrastructure manages proxy rotation and session pooling solely to handle rate limits on public endpoints; no user credentials belonging to third-party platform users are stored or used.

You are solely responsible for ensuring that your use of any data obtained through the Service complies with all applicable laws, including but not limited to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and the terms of service of any third-party platforms from which data is sourced. Datapio provides access to data as a technical service; the legal responsibility for how you store, process, and use that data rests with you.

7. Intellectual Property

All rights, title, and interest in the Service — including its design, source code, branding, trademarks, and documentation — are and remain the exclusive property of Datapio. These Terms do not grant you any rights to use our trademarks, logos, or brand features. You retain ownership of any data you lawfully obtain through the API, subject to applicable third-party terms and law.

8. Service Availability and SLA

We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to scheduled maintenance, updates, third-party outages, or circumstances beyond our reasonable control. Credits are not automatically refunded for downtime; however, we may issue credit adjustments for significant outages at our discretion.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of data, or non-infringement. We do not warrant that scraped data will be complete, accurate, or up to date.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Datapio and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill, arising from or related to your use of the Service — even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any claim arising from these Terms or the Service is limited to the greater of (a) the total amounts paid by you to Datapio in the 12 months preceding the claim, or (b) $50 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless Datapio and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate the relationship at any time. We may suspend or terminate your account immediately for violation of these Terms, fraudulent activity, or any other conduct we deem harmful to the Service or its users. Upon termination, your right to access the Service ceases immediately. Unused credits are not refunded upon termination for cause. Provisions of these Terms that by their nature should survive termination will survive.

13. Modifications to Terms

We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice via email or a prominent notice on the website. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law and Disputes

These Terms are governed by applicable law without regard to conflict of law principles. Any disputes arising from these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration or the courts of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
